Raw Materials Research and Development Council Act

This is an Act to establish a council known as The Raw Materials Research and Development Council to develop local raw materials and co-ordinate research efforts, especially in relation to raw materials acquisition, exploitation, conservation and development. The functions of the Council shall be to draw up policy guidelines and action programmes on raw materials acquisition, exploitation and development) to review from time to time, raw material resources availability and utilisation with a view to advising the Federal Government on the strategic implication of depletion, conservation or stock-piling of such resources, to encourage publicity of research findings and other information relevant to local sourcing of industries etc.

Copra (Inspection for Export) Regulations.

These regulations provide rules for the storage, sealing, packing, handling and inspection of copra destined for exportation. Where copra inspected, graded, sealed and marked for export by the Produce Inspection Service of any State is delivered at any port for shipment, officers of the Federal Produce Inspection Service shall conduct check-tests on the batch. Copra lots may be condemned or be made subject to treatment by fumigation.

Produce (Enforcement Of Export Standards) Act

An Act to make provision for the inspection of commodities for export from Nigeria at ports of shipment, for enforcement of grades and standards of quality in respect of such commodities, and matters incidental to the execution of the powers conferred by this act. It establishes The Produce Inspection Board and provides for the control of produce destined for exportation. The act shall apply to the produce described in the first schedule to this act. The board shall have advisory functions towards the Minister and states of The Federation. The act also empowers the Minister to make emergency orders for the control in Lagos of pests affecting produce. Where any produce is found within Lagos to be infested or suspected to be infested with any pest, a produce officer may make such order as he may deem necessary for the treatment of such pest. The act also defines wrongful grading of produce to be an offence.

Pest Control of Produce (Special Powers) Act.

This is an Act to provide for the inspection of produce for pests before export at all sea and airports in Nigeria and other matters ancillary thereto. It defines powers of inspection and enforcement of any person specially authorized by the Minister of commerce as a pest control inspector of produce. Power of entry conferred by this act shall include the power to fumigate to eradicate or control pest infestation of produce and the power of condemnation of produce. The act also defines the offence of obstruction of inspectors and grants powers to the Minister to make regulations generally for this act in consultation with the Produce Inspection Board.

Nuclear Safety and Radiation Protection Act.

This is an Act to establish the Nigerian Nuclear Regulatory Authority whose functions shall include the control and regulation of the use of radioactive substances, material, equipment, emitting and generating ionizing radiation. It establishes the Nigerian Nuclear Regulatory Authority and its governing board and the National Institute of Radiation Protection and Research. It also provides for the control of ionizing radiation and the exploration, etc. of materials containing radioactive substances and the packing and transportation of radioactive material and radioactive waste. The Nigerian Nuclear Regulatory Authority shall be charged with the responsibility for nuclear safety and radiological protection regulation in Nigeria. The act requires registration of premises where sources of ionizing radiation are kept. It also provides that no person shall produce or market any consumer product containing radioactive substances without license issued by the Authority.

Where the Secretary of the Tribunal believes that a prima facie case is shown against: (a) a developer; or (b) the control department; (c) any other person, he or she shall formulate the appropriate charge or charges and forward them to The Tribunal together with all the documents to be considered by The Tribunal. Appeal against the decisions of The Tribunal may be had with the High Court of the Federal Capital Territory of Abuja.

Fertilizer (Control) Act

This is an Act to provide for the control of the sale and distribution of fertilizer and matters connected therewith. This Act prohibits the dealing in, selling or distributing of fertilizer in any place not designated for sale or distribution of fertilizer without the permission of the appropriate authority (as defined). The appropriate authority may declare any place to be an approved selling or distributing point to sell or distribute fertilizer. Notwithstanding anything contained in any enactment, no person shall export fertilizer out of Nigeria. The Act defines other offences in respect of the handling of fertilizers, prescribes penalties for such offences and provides for measures of enforcement.
